5. USE AND PROTECTION OF PASSWORD AND ID

Spiritual Legacy may assign a password and account ID so you can access certain areas of the Services.

You acknowledge and agree that you are solely responsible for all access to and use of the Services by anyone using your password and account ID, whether or not such access is authorized, including all communications, transmissions, and any financial obligations that may result.

You are solely responsible for protecting the security and confidentiality of your password and account ID. You must immediately notify Spiritual Legacy of any unauthorized use or any breach or threatened breach of security.

6. SYSTEM REQUIREMENTS

Use of certain areas of the Services may require internet access and compatible software, applications, devices, or other system components (“Software” and “Devices”).

Spiritual Legacy may modify the system requirements for the Services at any time, in whole or in part, without notice. Fees from your internet provider, device provider, or app marketplace may apply and are your responsibility.

7. SUBMISSIONS (USER-GENERATED CONTENT)

You may post or submit reviews, comments, photographs, and other content, and you may send communications or suggestions (collectively, “User-Generated Content”), so long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing, or otherwise harmful to third parties.

You may not use a false email address, impersonate any person or entity, or otherwise mislead as to the origin of User-Generated Content.

By submitting User-Generated Content, you grant Spiritual Legacy a perpetual, non-exclusive, irrevocable, fully-paid, royalty-free, sublicensable, and transferable worldwide license to use, reproduce, modify, adapt, translate, publish, display, distribute, and create derivative works from such User-Generated Content in any media, for any lawful purpose, with or without attribution.

You represent and warrant that:

You own or control all rights to the User-Generated Content you submit.

The User-Generated Content is accurate.

Use of the User-Generated Content does not violate these Terms of Use, our Privacy Policy, or the rights of any third party.

You agree to indemnify Spiritual Legacy for claims arising from User-Generated Content you submit.

8. CONTENT LINKED TO THE SERVICES

The Services may contain links to third-party sites or services that are not controlled by Spiritual Legacy. Different terms and privacy policies may apply.

Spiritual Legacy is not responsible for examining or evaluating any third party offerings, and does not warrant any third party products, services, or content.

9. DISCLAIMER OF WARRANTIES

THE SERVICES AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES OR SERVERS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SPIRITUAL LEGACY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES.

ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES.

ANY CONTENT OBTAINED FROM THE SERVICES.

IN NO EVENT SHALL SPIRITUAL LEGACY’S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES EXCEED THE GREATER OF ONE HUNDRED UNITED STATES DOLLARS (US $100.00) OR THE AMOUNT YOU PAID SPIRITUAL LEGACY IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

12. COPYRIGHT COMPLAINTS

We respect the intellectual property rights of others. If you believe that your work has been copied in a way that constitutes copyright infringement, please contact us with a detailed notice identifying the copyrighted work and the allegedly infringing material.

13. AMENDMENT

We reserve the right, in our sole discretion, to change, modify, add, or delete portions of these Terms of Use at any time. Your continued use of the Services after any changes constitutes acceptance of the revised Terms of Use.

14. TERMINATION

These Terms of Use are effective until terminated by you or by us.

You may terminate your use of the Services at any time by discontinuing access and destroying any downloaded materials obtained from the Services.

Sections that by their nature should survive termination will survive.

These Terms of Use will be governed by the laws of Mexico, without regard to conflict of law principles.

Any dispute relating to the Services will be submitted to confidential binding arbitration in Mexico, except that we may seek injunctive or other equitable relief in any court of competent jurisdiction in Mexico to protect our intellectual property rights.
